Sponsored in part by Kybernan Legal Solutions LLC\nHow long do I have to keep my dental charts?\nThe Supreme Court of Ohio recently upheld the constitutionality of the state’s four-year statute of repose in medical and dental malpractice actions.  A statute of repose is a provision that sets a time frame in which a legal right extinguishes. In other words\, the statute of repose places an effective time limitation on when dental malpractice suits may be filed against a treating dentist. Ohio’s statute of repose bars actions filed more than four years after the date of treatment\, except in the case of those patients who are mentally infirm and with minors\, in which case the four years begins to run upon emancipation. \nDentists had previously been instructed to retain patient records indefinitely to aid in the defense of a lawsuit. However\, this favorable court ruling may help relieve dentists’ record-keeping burden.  There may be circumstances where a dental office must maintain records for a certain period of time; for instance\, the retention requirement for Medicaid records (6 years) and Medicare records (7 years). Participating provider agreements also generally specify record retention requirements\, as well as many professional liability insurance agreements. As we consider the timing and extraction\, or non-extraction of orthodontic treatment\, a major change in the size of the box will occur. The tongue being a hydrostat with a fixed volume which will not change\, the shape can change\, but not the volume\, is the beginning of sleep disordered breathing which eventually can progress to sleep apnea. The patient changes their head posture to have a more adequate airway which directly affects TMJ mechanics leading to jaw joint and cervical dysfunction. He earned his M.S.D. (Master of Science in Dentistry) at the Indiana University Graduate School of Orthodontics and began his practice in 1971. \nDr. Diers has taken an active part in professional and civic organizations in the Greater Cincinnati are. He has served as president of the Ohio Valley Orthodontic Society\, The Keely Dental Society of Butler County\, the Greater Cincinnati Dental Study Club\, and the Hamilton-Fairfield Junior Chamber of Commerce. \nDr. Diers is board-certified by the American Board of Orthodontics and a member of the American Association of Orthodontists\, which sets the professional standards for orthodontists in the United States. He is a member of the consulting staff at Children’s Hospital in Cincinnati and has been appointed Assistant Clinical Professor of Orthodontics at the Indiana University School of Dentistry and the Medical College of Georgia. As an expert on orthodontic developments\, Dr. Diers has published articles in a number of journals and has spoken to gatherings of health-care professionals at universities and state societies around the country and the world. \nAs a result of his extensive research and training\, Dr. Diers is able to treat most patients without removal of permanent teeth\, by utilizing the latest state of the art procedures; Functional appliances for jaw growth\, Self-ligating bracket systems for more efficient tooth movement\, Invisible braces-Invisalign system\, Accelerated orthodontics-treatment n 6-9 months\, Sleep apnea appliances\, and TMJ-treatment of jaw\, joint problems. \nDr. Diers\, through his research\, has obtained two U.S. Patents: US 8\,371\,309 B2\, Intraoral device upper airway disorders and US 7\,833\,013 B2. For centuries opioids have been used to control pain and suffering\, but at what cost to us\, our families\, and our dental practices? What are our alternatives for controlling post-operative pain?
